Employer's liability for compensation

If personal injury is caused to an employee by accident arising out of and in the course of employment, the employer is liable to pay compensation — except where disablement lasts under three days or the employee was drunk, wilfully disobeyed safety rules or removed a safety guard.

Amount of compensation

For death, fifty per cent of monthly wages multiplied by the relevant age factor or ₹1,20,000, whichever is more; for permanent total disablement, sixty per cent of wages multiplied by the factor or ₹1,40,000; wage ceiling as notified.

Compensation to be paid when due and penalty for default

Compensation is payable as soon as it falls due; the Commissioner shall direct interest at twelve per cent and may impose a penalty of up to fifty per cent for unjustified delay.

Notice and claim

Notice of the accident as soon as practicable and claim within two years of the accident or death; the Commissioner may condone delay for sufficient cause.
