Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013

Sexual harassment

Unwelcome acts or behaviour — physical contact and advances, a demand or request for sexual favours, sexually coloured remarks, showing pornography, or any other unwelcome physical, verbal or non-verbal conduct of a sexual nature.

No woman shall be subjected to sexual harassment at any workplace; implied or explicit promises or threats about employment, hostile work environment and humiliating treatment are circumstances amounting to harassment.

Constitution of Internal Committee

Every employer of a workplace with ten or more employees shall constitute an Internal Committee with a senior woman presiding officer, two employee members, and one external member from an NGO or familiar with the issues; at least half the members must be women.

Complaint of sexual harassment

Written complaint within three months of the last incident (extendable by three months for reasons recorded); the IC may assist a complainant unable to write.

Inquiry into complaint

The IC shall complete the inquiry within ninety days, following principles of natural justice, with powers of a civil court to summon and examine; both parties get an opportunity to be heard.

Inquiry report

Report within ten days of completion; if the allegation is proved, the employer shall act on the recommendation (action per service rules, deduction of compensation) within sixty days.

Duties of employer

Provide a safe working environment, display the penal consequences and IC composition, organise workshops and awareness programmes, assist the complainant in filing a criminal complaint, and treat sexual harassment as misconduct under the service rules.
