Documents of which registration is compulsory

Instruments of gift of immovable property, non-testamentary instruments creating or extinguishing rights in immovable property worth ₹100 or more, and leases of immovable property from year to year or for over one year must be registered.

Instruments relating to immovable property below ₹100, leases not exceeding one year, wills and certain other documents may be registered at the parties' option.

Time for presenting documents

A document (other than a will) must be presented for registration within four months from its execution; s. 25 allows condonation of up to four further months on payment of a fine.

Effect of non-registration

An unregistered compulsorily-registrable document does not affect the immovable property or operate as evidence of the transaction, but may be received as evidence of a contract in a suit for specific performance or of a collateral transaction.
